Florida Attorney General James Uthmeier announced in West Palm Beach on Monday that state is suing OpenAI and CEO Sam Altman, accusing the company of putting children at risk by marketing ChatGPT as safe while allegedly failing to address serious dangers tied to the artificial intelligence chatbot.

The lawsuit, filed in Highlands County, is what Uthmeier called the nation's first state-led legal challenge against OpenAI. Florida alleges the company violated the state's Deceptive and Unfair Trade Practices Act by prioritizing growth and profits over user safety.

"OpenAI and Altman ignored internal and external safety warnings, put children at great risk, and allowed a dangerous product to reach millions of Floridians," Uthmeier said.

At the center of Florida's case is a claim that children can access ChatGPT without meaningful parental oversight, despite studies cited in the lawsuit showing millions of minors already use AI chatbots.

"Eight or nine years old, without parental controls, without parental protection, getting advice from something that mimics human behavior," Uthmeier said during a news conference in West Palm Beach.
